A federal appellate court recently rejected a facial challenge to the constitutionality of statutory damages under the federal Fair Credit Reporting Act. The decision by a three-judge panel of the 11th U.S. Circuit Court of Appeals was the first circuit court ruling on the question, said Deepak Gupta of Public Citizen Litigation Group, who argued in defense of the damages provision along with the United States.
