Outcast New York State Trooper Fails to Prove Harassment

Police refusal to uphold the "blue wall of silence" is no basis for a claim under the Equal Protection Clause, ruled the 2nd U.S. Circuit Court of Appeals. The court found the alleged retaliation against ostracized state trooper Dennis J. Diesel, labeled a "rat" for cooperating in an internal affairs investigation, was a "reasonable response" to Diesel's own misconduct in an unrelated incident.

Doe claims the commercial, which was widely viewed on YouTube, allegedly resulted in her being the subject of "hundreds of demeaning and insulting comments." She is claiming loss of reputation, lost earnings and emotional distress.
