Videotape Revives Lawsuit Against Ford Motor Co.

When the Rev. Leon Manigault's Ford Crown Victoria suddenly accelerated and hit a house in 1993, leaving him severely injured, it triggered nearly a decade of legal battles. Now his fight is newly revived by the chance discovery of the audio portion of a Ford video played at trial -- but without sound. The tape -- obtained by TV news magazine "Dateline NBC" -- has caused the Ohio Supreme Court to order Ford back to trial.

Marking the first time a federal circuit has held that a debt-collection lawyer's affidavit is not protected by absolute immunity, the 6th Circuit has ruled that lawyers who file affidavits in garnishment proceedings may be sued in federal court under the Fair Debt Collection Practices Act. Richard Rubin, a solo who represents consumers in credit and debt collection abuse litigation, welcomed the decision, saying it will make collection lawyers "very careful ... that they don't misrepresent anything."

Ohio Court Creates Charity Funded by Punitives

The Ohio Supreme Court's December ruling in a bad-faith case against a major health insurer is believed to be the first time a court has ordered the creation of a charity to be funded with punitive damages. The court upheld $30 million of a punitive damage award against Anthem Insurance in a suit over the treatment of a patient who died, and directed the creation of a memorial cancer research fund in the patient's name.
