Calif. High Court Is of Two Minds on Jury Trial Waivers
A growing and controversial practice whereby companies agree to waive potential jury trials in civil cases long before any dispute arises received a healthy debate by the California Supreme Court on Wednesday. But the justices gave no clear indication how they would rule. Several judges seemed strongly opposed to the practice, while others appeared to believe it might actually be a boon to overburdened trial courts.Gibson Dunn's Daniel Kolkey, who argued for the merchants, told the California Supreme Court a 1971 law that says personal information can't be recorded can't possibly apply to Internet transactions.
