Eviction Notices for Cybersquatters

Law and order is taking hold in the Wild West of the Internet. Cybersquatters who try to steal domain names from their legitimate owners have long plagued online commerce. But the Uniform Domain-Name Dispute Resolution Policy -- which just marked its fifth anniversary -- has resolved more than 13,000 domain name disputes, 81 percent of them in favor of trademark holders. And if companies need stronger remedies, they can turn to the federal anti-cybersquatting statute.

The legal market in Brazil has been particularly active in recent months, with firms like Milbank and Gibson Dunn announcing they were opening Brazilian offices. But a recent ethical and disciplinary panel opinion of the Sao Paulo Bar illustrates the mounting tension over the influx of foreign firms into one of the world's fastest-growing economies. Although only advisory, the opinion indicates where a more formal ruling might fall if a case were brought against major U.S. firms operating in Brazil in alliance with local firms.

Chapter 11 Creditors Can't Sue for Avoidance of Fraudulent Transfers

The 3rd U.S. Circuit Court of Appeals invalidated a widely used mechanism by which Chapter 11 creditors could, with bankruptcy court permission, sue to avoid fraudulent transfers. The court affirmed a finding that creditors are not proper parties to bring avoidance claims under 11 U.S.C. 544(b). The ruling makes the 3rd Circuit the first to disallow such suits, which are lodged when debtors fail to bring avoidance claims.
