Building Delayed, Donation Denied

A federal appeals court has ordered the return of a $2.8 million donation to the Lubavitchers -- an orthodox Jewish movement -- because the group failed to use the funds to open and name a school in Brooklyn by an agreed-upon deadline. Senior U.S. District Judge Clarence C. Newcomer gave the group an extension when they missed the 1995 deadline. But Newcomer's patience wore out, and he ruled that the money should be returned since the school was still far from complete.

When the case concluded last week, it had clearly brought some big payoffs to plaintiffs lawyers. Less clear was how much good it did for medical consumers and providers.
