Who Do Conservatives Want for the High Court?

Religious and social conservatives may not want Alberto Gonzales filling the Supreme Court seat vacated by Sandra Day O'Connor -- but who, exactly, would make them happy? Though a flock of conservative federal appellate judges are standing by, the would-be justices are not unblemished. And with the retiring O'Connor viewed as a swing vote on abortion, the views of any nominee on that issue will likely dominate the confirmation process.

Operators of Ponzi Scheme Hit With $8.75 Million Award

The Virginia-based operators of a Ponzi scheme were hit with a $8.75 million verdict Jan. 23 for civil RICO violations, fraud and conspiracy. Leader who helped build Orrick into global force is leaving

"I got an offer on this space this morning," says Ralph Baxter as he strides through the glass-walled conference rooms that make up the top floor of the 10-story Orrick, Herrington & Sutcliffe building in San Francisco's SoMa neighborhood. It's just one of many times in conversation, this morning in early March when Baxter makes no distinction between the law firm and himself. But the seamlessness between Baxter and Orrick, which he has led for more than 22 years, isn't limited to issues of grammar. Baxter is perhaps more intertwined with the institution than any other nonfounder head of an Am Law 200 firm. Soon, Baxter will be signing off for good.

For One Law Firm, an Unquiet Death

Not since the crash of Brobeck, Phleger & Harrison has a law firm flamed out as spectacularly as Coudert Brothers. The firm once had 28 offices and 600 lawyers, and though its financial performance was fading, it was seen as a pioneer in international law. But that scope also helped undermine Coudert, which faces lease obligations from Singapore to San Francisco, and difficulties accessing money in Frankfurt and Tokyo. It was once common for Coudert partners to speak many languages. Now its creditors do.

Management: Raising the Bar on Legal Writing

In 1596, Chancellor Egerton of Westminster Hall cut a hole through the center of a lawyer's rambling 120-page tome, stuffed the lawyer's head through it, and paraded him before the entire court at Westminster Hall. Though humiliating, this early lesson in the offensiveness of legalese was apparently lost on the greater legal community. Only in recent years have law firms developed strategies to cultivate articulate writers.

Houston, We Have an Arbitration

A biennial survey of international arbitration shows one of the most marked trends to be a surge in energy disputes, with oil, gas and utility sectors accounting for more than a third of this year's survey. Another trend: an increase in Latin American cases, which now represent 34 percent of the survey, including 48 percent of treaty-based disputes between states and foreign investors. Thanks to their energy roots and southern exposure, law firms with Texas ties are riding especially high.
