For want of a quorum, the Supreme Court on Monday allowed a controversial lawsuit brought by South African citizens to proceed against American and foreign corporations for their role in perpetuating apartheid. Backed by the Bush administration and the South African government, the companies had asked the high court to reverse a 2nd Circuit ruling that allowed the suit to proceed under the Alien Tort Statute.
