Counsel Comes South To Test Fairness in Ga. Death Cases
Georgia is the only state that does not mandate that the condemned have a right to lawyers for the habeas process. The idea behind representation is to ensure death row inmates' trials and sentencing meet constitutional standards of fairness before they are put to death. If the U.S. Supreme Court declared such a right, states would be forced to ensure that condemned inmates have competent legal representation for their habeas petitions. But the court recently turned downed the chance to make that ruling.Banner Supply Company cut the first major deal with plaintiffs so far in the multidistrict litigation over defective Chinese drywall on Tuesday. It took the opportunity to bash another defendant, Knauf, for allegedly lying about the safety and fitness of drywall it sold to Banner.
Just a month after Banner Supply Company reached a $55 million settlement with plaintiffs in the Chinese drywall MDL in New Orleans, Banner's lawyers are claiming that the Knauf Chinese subsidiary that made the drywall is the one to blame. Knauf's lawyers at Kaye Scholer beg to differ.
Plaintiffs lawyers are still making hay with claims sparked by a Nevada Hepatitis C scare tied to sloppy use of the sedative Propofol. The latest target, UnitedHealth Group, was socked with a $500 million punitive damages verdict this week by a state court jury in Las Vegas. The verdict is the biggest so far this year.

A Telfair County jury has awarded $2.8 million to a man whose wrecker was hit head-on by a skidding, jackknifed tractor trailer.The October 2008 crash on Georgia Highway 31 in Telfair County crushed Raford E. Horton's pelvis and put him in the hospital for 45 days, according to court records. After a Newton County man had both his legs partially amputated as a result of a railroad car accident, he filed suit in federal court. One defendant, the owner of the railroad car that ran over the plaintiff, settled for undisclosed terms in the midst of a deposition.
