The U.S. Supreme Court has lengthened the list of potentially landmark rulings in the new term. The justices agreed to decide whether Congress exceeded its lawmaking power under the commerce clause and Sec. 5 of the 14th Amendment when it created a civil remedy for victims of gender-motivated violence in the 1994 Violence Against Women Act (VAWA). The combined appeals - U.S. v. Morrison and Brzonkala v. U.S. States Review Licenses for Foreign Attorneys
Two cases involving foreign attorneys' rights to sit for the bar exam recently reached Massachusetts' highest court, the latest sign that states are wrestling with the issue of when attorneys from other countries should be allowed to practice in the United States. Nine states are reviewing whether to allow the licensing of "foreign legal consultants."
