Management: Raising the Bar on Legal Writing

In 1596, Chancellor Egerton of Westminster Hall cut a hole through the center of a lawyer's rambling 120-page tome, stuffed the lawyer's head through it, and paraded him before the entire court at Westminster Hall. Though humiliating, this early lesson in the offensiveness of legalese was apparently lost on the greater legal community. Only in recent years have law firms developed strategies to cultivate articulate writers.

Houston, We Have an Arbitration

A biennial survey of international arbitration shows one of the most marked trends to be a surge in energy disputes, with oil, gas and utility sectors accounting for more than a third of this year's survey. Another trend: an increase in Latin American cases, which now represent 34 percent of the survey, including 48 percent of treaty-based disputes between states and foreign investors. One lawyer said the file gives evidence "showing how the FBI and DOJ were out to discredit opponents of Rehnquist." A professor who has written on justices' health through history said the file raised questions about "the long-term effect on Rehnquist" of using such a strong drug for so long.

Midsize Firm Steefel Regroups as Partners Depart

Steefel, Levitt & Weiss, a midsize San Francisco-based firm known for its real estate practice, has lost 11 partners since January 2005, including two who announced this week they're leaving for Reed Smith. But the 65-lawyer firm is working on building itself back up. "The size that I think Steefel can do a good job at is a firm of 110 to 125 lawyers," says Chairman Barry Lee. Observers say midsize regional firms like Steefel can prosper indefinitely, as long as they can retain or replace big-book partners.
