Even if it does not directly pay the worker's wages, a company that hires a temporary laborer is immune from suit under the Workers' Compensation Act if it can show it controlled the manner and performance of his work, a federal judge ruled. Raymond Shaw was a temporary worker placed by American Staffing Resources Inc. at Thrift Drug's warehouses where he tripped on a bolt within his first two weeks on the job. The judge found Shaw met the definition of a "borrowed employee" under Pennsylvania law.
