Lawyer Seeks Stay of Order Banning Him From Practice

Labor and employment attorney Loring Spolter said Tuesday that he will ask for an emergency stay of an unusual order by U.S. District Judge William Zloch imposing $110,000 in penalties and banning him from practicing in the Southern District of Florida for 3 1/2 years. The ban is part of a long-running battle over Spolter's claims that Reagan appointee Zloch is biased against women and minorities in employment cases because of his conservative views and Catholic faith.

HMOs face the sharpest attack yet on their nearly inviolable protection from patient lawsuits. Using a recent Supreme Court decision originally hailed as a victory for HMOs, plaintiffs' attorneys are seeking to remove the protections that have kept HMOs out of state courts -- and they've gotten a boost from the Department of Labor's endorsement of patients' right to sue HMOs under state law.

As Barry Ostrager tells it: But for Herbert Wachtell's ingenuity and persuasiveness, there would be no World Trade Center insurance litigation. There would be no $3.55 billion dispute over whether the Sept. 11 attacks were two insurable events, not one, and, therefore, how much money is owed to Wachtell's client -- who has a 99-year lease on the WTC. Of course, Ostrager's salute is a bit mitigated by his role as counsel to one of the insurance underwriters.
