Franchise Fee Charged Cable Provider Deemed Reasonable

In a precedent-setting ruling, a federal judge has held that the city of White Plains, N.Y., may regulate the installation of a telecommunication provider's fiber optic cable network and be compensated by the carrier for using city property to provide services to the public. The proposal of an annual 5 percent franchise fee on all revenue was deemed fair and reasonable.

IBM Corp. and China's Lenovo Group Ltd. are negotiating with federal regulators to assuage any national security concerns over their $1.7 billion deal, sources said. The Committee on Foreign Investments in the U.S., a multiagency panel that reviews acquisitions of U.S. businesses by foreign companies, is expected to decide by Friday whether to launch a formal investigation into the deal, under which Lenovo would acquire IBM's PC manufacturing business.
