Confusion Over Representation Influences $2.9 Million Malpractice Settlement

Preparing documents for a series of real estate loan transactions entangled a former Austin, Texas firm in a legal malpractice nightmare that ended with the firm paying about $5 million to defend itself and settle with investor-lenders. Proposed Disciplinary Rule Changes Target Conflicts, Scienter, Sex

For the first time in almost 20 years, the Texas Supreme Court has proposed comprehensive changes in the state's disciplinary rules for lawyers, including major amendments to conflicts rules and a new rule prohibiting lawyers from having sex with clients. Methodology

Texas Lawyer collected promotion announcements for 2010 shareholders and partners from 23 of the 26 largest firms in Texas. The 26 firms are the largest on Texas Lawyer's "The Texas 100" list published April 27, 2009, a ranking of Texas-based firms and Texas operations of out-of-state firms by the number of lawyers in the state. Texas Lawyer asked each firm to confirm the number of promotions and to provide the number of females and/or ethnic minorities promoted. The story compares data with the 2009 information gathered from the firms in the same way and published in Texas Lawyer's March 30, 2009, edition. Three of the 26 firms — Brown McCarroll, Gardere Wynne Sewell, and Hunton & Williams — announce new partners/shareholders after presstime on March 25.
