While the evidence provides a reasonable basis for a jury verdict in plaintiffs' favor on their claim that they were fired in violation of the EPPA based on their refusal to take polygraph examinations and on the results of a test illegally administered to a co-employee, defendant is entitled to a new trial because it was unfairly prejudiced by the evidence of racial discrimination offered by plaintiffs before they dropped their LAD claims, and because the damages awarded by the jury are grossly excessive.
