The New Jersey Supreme Court considered Monday the attorney general’s appeal of a lower court ruling that said prosecutors may not issue administrative subpoenas in whistleblower lawsuits after the statutory deadline has passed to either intervene or decline to participate.

How the court rules will determine whether the Attorney General’s Office will be allowed to issue subpoenas to a company, Medco Health Solutions Inc., which manages health benefit plans for public-sector workers, and two of its former senior executives.
