The New Jersey Supreme Court ruled Aug. 16 that a union laborer’s complaints of wage violations and alleged retaliation for his whistleblower activity are not automatically pre-empted by federal labor law.

In a unanimous ruling, the court reinstated a claim filed by plaintiff Salvatore Puglia against his former employer, Elk Pipeline Inc., alleging that he was laid off after complaining that Elk was violating the state’s Prevailing Wage Act (PWA) and the Conscientious Employee Protection Act (CEPA).
