The Appellate Division on Tuesday reversed the New Jersey Superior Court’s ruling that a wrongful termination complaint was frivolous and vacated an award of $10,000 in fees against the two pro se plaintiffs who brought the suit back in 2012.

In the initial complaint, Dr. Myrna B. Tagayun and her husband and office manager, Robert S. Mandell, asked the Superior Court to prevent Tagayun’s termination by AmeriChoice as a participating provider for the health care company’s HMO members.
