A former Goldman Sachs coder who had his federal convictions for allegedly stealing the company’s source code overturned has been allowed to press his suit claiming two FBI agents caused his malicious prosecution in state court, a New Jersey district court judge ruled June 15 on a motion to dismiss.

The plaintiff, Sergey Aleynikov, filed his suit in February 2015 after he spent nearly a year in prison for violating two federal laws in 2011. The U.S. Court of Appeals later overturned his convictions, finding that the statutes did not apply.
