A New Jersey appeals court has ruled that an arbitration clause in a contract may be unenforceable if the arbitration forum is not available in the event of a dispute.

A three-judge Appellate Division panel, in Kleine v. Emeritus at Emerson, said June 9 that compelling a plaintiff to go through arbitration when the arbitration forum called for in the contract is unavailable violates the state contract laws.
