A New Jersey appeals court has ruled that the state Attorney General’s Office may not issue administrative subpoenas in qui tam cases after the statutory deadline has passed for it to either intervene or decline to participate.

In a published ruling issued March 18, a three-judge Appellate Division panel overturned a decision by an Essex County judge that would have enforced the subpoenas issued by the office to a company that manages health benefit plans for public-sector workers and two of its former senior executives.
