A federal judge in Newark has rejected a motion to disqualify Gibbons from representing Cigna in a suit over reimbursement of out-of-network benefits.

U.S. Magistrate Judge Cathy Waldor of the District of New Jersey denied the motion to disqualify Gibbons despite claims by the plaintiff’s counsel in the case that the firm has a conflict in representing Cigna and the principals of the various plans. The plaintiff also unsuccessfully argued that Gibbons is conflicted because attorneys from the firm should be considered fact witnesses based on their investigation and discussion with witnesses in the case.
