Federal regulators have failed in their bid to punish Bayer Corp. for what they called overinflated claims about a probiotic supplement.

U.S. District Judge Jose Linares of the District of New Jersey on Sept. 24 denied the Federal Trade Commission’s motion to hold Bayer in contempt of a 2007 consent order for touting Phillips Colon Health. In the 2007 order, the company was directed to dial back advertising claims made in connection with a different product.
