01-2-7213 In the Matter of Application of Hoffer For a Permit to Carry a Weapon, App. Div. (6 pp.) Hoffer, formerly an auxiliary police officer in Hillside, and employed as a security guard for a private security company, appealed the denial of his application for a permit to carry a weapon. The application was denied for lack of justifiable need and public health, safety and welfare. The panel affirmed, finding that Hoffer failed to demonstrate an urgent necessity for self-protection based on specific threats or previous attacks demonstrating a special danger to his life and that the court did not err in considering the testimony of the Hillside Police Department training supervisor/liaison to the auxiliary police regarding Hoffer’s disciplinary record and the reason for his termination from the auxiliary police since the evidence upon which a final administrative agency decision was reached may include hearsay provided that, as here, the agency’s finding were not entirely based on hearsay evidence.
