ALTERNATE DISPUTE RESOLUTION
03-2-6938 County of Hudson v. PBA Local 109, App. Div. (per curiam) (3 pp.) Plaintiff-county appealed the denial of its application to vacate an arbitration award entered after the parties had participated in binding arbitration pursuant to a collective negotiations agreement. Defendant-union joined in plaintiff’s argument that the court erred when it held that the relief sought was barred based on lack of jurisdiction per Rule 4: 67-6. The panel reversed and remanded, finding that the award was not the product of an agency decision or a summary action and as such, under N.J.S.A. 2A:24-7, review of the award rested in the Law Division.
