A plaintiff has received approval from a federal judge in Camden, N.J., to amend her civil rights complaint with the proper identity of a John Doe defendant, but the inclusion of four others listed as fictitious parties have been denied as time-barred.

In an excessive force suit against the Atlantic City, N.J., Police Department, plaintiff Janine Constantino was allowed to add Joshua Godfrey as an additional defendant, even though the statute of limitations had expired in the case. But the other four parties she sought to bring into the case could not be added because addition of those parties did not “relate back” to the original complaint, U.S. Magistrate Judge Joel Schneider ruled.
