Schepisi & McLaughlin v. LoFaro, A-5426-10T2; Appellate Division; opinion by Kennedy, J.A.D.; decided and approved for publication April 29, 2013. Before Judges Messano, Ostrer and Kennedy. On appeal from the Law Division, Bergen County, No. L-1607-11. [Sat below: Judges Toskos and Powers.] DDS No. 15-2-9756 [19 pp.]

Slava Kornilov, a New Jersey resident, purchased two diamonds from East West Precious Metals of New York Inc. for $245,865. When Kornilov did not receive the diamonds, he filed suit in Bergen County seeking damages and injunctive relief (the New Jersey action). Kornilov’s motion for default judgment was granted, and the court ordered East West to give the diamonds to Kornilov within 10 days, failing which Kornilov would be entitled to place a hold of $245,865 on any bank account held by East West in a "constructive trust."
