A federal judge in Newark has dismissed a First Amendment suit against a billboard company that deemed an anti-abortion group’s messages too “disturbing” to run.

CBS Outdoor, as a private actor, is not subject to constitutional scrutiny, and the plaintiff failed to demonstrate that the privately owned billboards should be regarded as a public forum, District Judge Jose Linares ruled on Sept. 2 in Life Education Counsel Inc. v. CBS Outdoor Inc., 11-cv-01835.
