STATE COURT CASES

CONDEMNATION — EMINENT DOMAIN

44-2-0066 City of Long Branch v. Angelides, App. Div. (per curiam) (16 pp.) Plaintiff city appeals from a jury verdict that awarded just compensation for the condemnation of three properties of defendants in the aggregate amount of $2,025,000. The panel affirms, finding nothing about the trial court’s management of the trial, including evidentiary rulings regarding comparable sales and highest and best use, which engendered undue prejudice to the city requiring appellate intervention. Defense counsel’s passing comment about litigation challenging the redevelopment zone and his stray use of the word “blight” had no objective potential to undermine the jury’s fair consideration of the just compensation issues.
