03-2-9247 Malek v. Mobarek, App. Div. (per curiam) (11 pp.) Almost two years after a judgment was entered against plaintiff for $4,500, based on her failure to pay a loan as agreed, plaintiff filed an action seeking damages for personal injuries she allegedly sustained as a result of defendant assaulting her, repayment for the cost of food she provided to defendant which she claimed was part of repayment of the debt, and attorneys’ fees. At arbitration, plaintiff was awarded $30,000. On defendant’s appeal, the appellate panel affirms two Law Division orders. The first order granted defendant a thirty-day adjournment of the commencement of mandatory arbitration, on condition that he pay the sum of $1,212 to plaintiff as an attorney’s fee, along with costs of $55. The second order denied his request for recusal and for frivolous litigation sanctions against plaintiff.
