44-2-8058 City of Asbury Park v. Alvino, App. Div. (per curiam) (6 pp.) In this dispute regarding the value of condemned property, the panel affirms the jury’s award of the entire amount requested by defendant, finding that although defense counsel’s reference to “eminent domain abuse” at the outset of his summation was regrettable, the trial judge’s swift interruption of defense counsel’s summation, his firm direction that the phrase not again be used, and his clear and unambiguous instructions to the jury eviscerated any sting caused by counsel’s unfortunate reference.
