Over the last year, the federal government has enacted employment-related legislation that broadens the rights of employees and creates greater liability for employers. Employers and their attorneys should be aware of these important developments in employment law.

On January 1, the Americans with Disabilities Act Amendments Act of 2008 went into effect, broadening the scope of “disability” under the Americans with Disabilities Act and potentially expanding employers’ obligations to accommodate disabled employees. The act’s requirement that the term “disability” be interpreted in favor of broad coverage will make it easier for employees to seek protections in the workplace and to bring successful disability discrimination claims.
