ADMINISTRATIVE LAW — TEMPORARY DISABILITY BENEFITS

01-2-5598 Tatem v. Board of Review , App. Div. (per curiam) (7 pp.) Finding that petitioner voluntarily left his employment and was therefore found ineligible for unemployment benefits, which decision he did not appeal, and that he then worked only two and one-half weeks before the surgery that resulted in an inability to work, the panel affirms the Board of Review’s determination that he was not eligible for temporary disability benefits and, in light of N.J.S.A. 43:21-16(d), which mandates repayment of benefits for which a recipient was not eligible, that he must repay the disability benefits he received. [Decided Oct. 20, 2009.]
