(per curiam) (3 pp.) The panel affirms the action of the MVC in suspending appellant’s driving privileges in New Jersey pursuant to the Interstate Driver License Compact after he was convicted of “driving while ability impaired” in New York, finding that New Jersey’s driving while intoxicated statute, N.J.S.A. 39:4-50, is of a sufficiently similar nature as the New York statute as to fall under the compact. 01-2-3965 In the Matter of Bid Solicitation No. 08-X-39737 South Jersey Regional Airport, L.L.C. v. Division of Purchase and Property , App. Div. (per curiam) (12 pp.) Plaintiff appeals defendant’s final determination rejecting its bid to operate the South Jersey Regional Airport on the basis that its pricing structure calculating shared revenue on the net, as opposed to gross, fuel sales was a material, nonwaivable deviation from the bid specifications. According the division director the deference that is due, the panel affirms her decision, finding that granting plaintiff a waiver to submit a pricing structure based on net fuel sales would defeat the express purpose of maximizing revenue to the state and would put plaintiff in a more advantageous position than the other bidders. Further, the division was not obligated to negotiate with plaintiff rather than reject its bid nor was it obligated to waive the deviation because it had accepted a similar deviation in a bid at the other state-owned airport.
