In the Name of Litigation — An Appellate Division panel on Friday ordered Bruce Nagel to pay $11,630 in counsel fees to an adversary he sued over her questioning of his client about the death of the client’s baby.

“Counsel must be free to explore and probe the claims that have been asserted against his or her client,” said Judges Dorothea Wefing, Lorraine Parker and Laura LeWinn. “To expose the attorney to the risk of litigation on the basis of such questioning would subvert the underlying policy of the litigation privilege.”
