In a matter of first impression, the New Jersey Appellate Division held a property owner was not liable for a dirt bike rider’s injuries after he struck a steel cable on the quarry grounds, finding it was for a legitimate business purpose and not an effort to deter dirt bike riders from the area.

Bryan Callahan claimed he sustained severe injuries when he was riding his dirt bike on quarry ground owned by defendants Tri-Borough Sand and Stone, Eureka Stone Quarry and James D. Morrissey. Callahan’s injuries allegedly happened when he struck a steel cable that was part of the machinery used to dredge the quarry. The incident occurred on a Sunday when the business was closed, according to the opinion.
