In an unpublished opinion last week, the New Jersey Appellate Division sided with a Mercer County Superior Court order that pharmaceutical company Mezzion Pharma turnover information on its manufacturing process for udenafil, an erectile dysfunction drug.

Mezzion moved for leave to appeal a discovery order granted by Judge Douglas H. Hurd, which the company alleged would reveal competitive trade secrets. In the underlying case, Mezzion Pharm. v. Dr. Reddy’s Laboratories, Mezzion sued drug manufacturer Dr. Reddy’s Laboratories after an inspection by the Food and Drug Administration of the drugmaker’s India facility resulted in an FDA Form 483 report, notifying it of several problems regarding manufacturing compliance.
