A New Jersey appeals court ruled that a school district acted properly when it told a prospective employer that a teacher’s social media posts made her the subject of a “sexual misconduct investigation.”

The Appellate Division upheld a finding by acting State Education Commissioner Angelica Allen-McMillan that the Hackensack school district responded appropriately when it received an inquiry about the teacher, identified as A.B., pursuant to a 2018 statute known as the “Pass the Trash Law.”
