Gov. Phil Murphy successfully appealed a Superior Court order denying his motion to dismiss a defamation claim brought by Christopher Neuwirth, a former assistant commissioner for the Department of Health, the New Jersey Appellate Division held Wednesday.

Neuwirth claimed that in April 2020, State Police Superintendent Patrick J. Callahan asked him to have someone perform COVID-19 testing in DOH’s Public Health and Environmental Laboratories for relatives of George Helmy, the governor’s chief of staff. According to the opinion, Neuwirth did not want to grant the favor because he believed the request was incompatible with public policy and a misuse of government resources and power.
