In a published decision, the New Jersey Appellate Division ruled that parties may not contractually expand the scope of judicial review in an arbitration agreement that is governed by the Federal Arbitration Act.

The court held that a provision in the agreement permitting a court to review an arbitrator’s award for errors in state law is unenforceable, but severable from the remainder of the agreement.
