The New Jersey Appellate Division ruled that a trial judge was wrong to allow the Ocean Casino Resort in Atlantic City to proceed with business interruption insurance claims for losses incurred during the pandemic shutdown.

According to the opinion issued per curiam by the court, the casino, operated by AC Ocean Walk LLC, sued its insurers seeking property and business interruption insurance coverage for loss of income during the COVID-19 closure of all nonessential businesses ordered by Gov. Phil Murphy. The 138,000-square-foot casino contains overnight accommodations, bars, cafes, and restaurants among other amenities.
