The New Jersey Appellate Division has ruled that, because the New Jersey Supreme Court deemed a period of COVID-19 court closures to be a “legal holiday,” they did not toll the statute of limitations.

According to the appeals court’s June 13 opinion, Juan J. Barron appealed a Union County Superior Court order dismissing, with prejudice, his automobile-accident case for failure to file within the two-year statute of limitations. Barron asserted that his complaint was timely as the Supreme Court tolled the statute of limitations in its fourth omnibus order on June 11, 2020.
