The New Jersey Appellate Division rescinded its original opinion dismissing a plaintiff’s Survivor’s Act claim after the state Supreme Court issued an order remanding the issue in consideration of recent changes to the legislation.

According to the appeals court’s June 14 opinion, Damaris Chandler brought a wrongful death claim against Todd W. Kasper, Thomas C. Kasper, Kazz Inc., doing business as Kasper’s Corner, and Kasper Automotive as administrator ad prosequendum for the estate of her father, Joseph E. Chandler Jr. Chandler was struck by a vehicle while crossing the street on Dec. 21, 2016, and died of his injuries six days later. The vehicle was operated by Todd W. Kasper and owned by Thomas C. Kasper.
