A New Jersey appeals court has overturned a jury’s no-cause verdict in a premises liability suit based on the trial testimony of a defense expert on matters not contained in his report.

In a cautionary tale of expert testimony that did more harm than good, the appeals court said Judge Martha Lynes erred by allowing professional engineer David Behnken to testify at trial about circumstances at homes of the defendants’ neighbors.
