The state Attorney General’s Office may not issue administrative subpoenas in qui tam cases after the statutory deadline for government participation has passed, the New Jersey Supreme Court has ruled.

In a 3-2 ruling, the court upheld an Appellate Division panel that overturned an Essex County judge’s order enforcing the subpoenas. The subpoenas were issued to a company that manages health benefit plans for public-sector workers and two of its former senior executives.
