In a case that has drawn nationwide interest, the Appellate Division, Second Department, has ruled that a 2005 federal law trumps an 84-year-old state statute that imposes vicarious liability upon car-rental and long-term leasing companies. The unanimous panel ruled that Congress was acting well within its powers to regulate interstate commerce when it passed a provision barring the imposition of vicarious liability upon companies in the car-rental and leasing businesses.
