A PRENUPTIAL agreement cannot be transformed into a separation agreement for purposes of obtaining a conversion divorce, a state appellate court has ruled.

A provision in a prenuptial agreement providing for the future separation of a husband and wife “is against public policy and is unenforceable,” the Appellate Division, Second Department, said Monday in Halsey v. Halsey, 2001-00962.
