MINEOLA – Two Nassau Supreme Court justices have reached opposite conclusions regarding an insurance law discovery rule unsettled in the Second Department.

The recent decisions by Justices Stephen A. Bucaria and Anthony L. Parga pertain to surveillance tapes recorded by insurance companies in cases where policyholders are suing for coverage. The rulings address whether an insurance company is required to disclose the tapes’ contents prior to the plaintiffs’ deposition.
