AN APPELLATE panel has endorsed a broad interpretation of premises liability for landlords who have surrendered full control of a building in a lease.

The first-impression ruling from the Appellate Division, First Department, held that a landlord who net leases property to a tenant without reserving a right of re-entry may still be liable for defects via a non-delegable duty under Multiple Dwelling Law �78.
